These Terms of Service ("Terms") govern your access to and use of Lumee, a mobile application for personal journaling, manifesting, and vision boards ("the app" or "Lumee"). By downloading or using Lumee, you agree to these Terms. If you do not agree, please do not use the app.

Lumee is operated by Nadav Gelbard, an individual based in Israel ("we," "us," or "our").

1. Eligibility

You must be at least 13 years old to use Lumee. By using the app, you represent that you are 13 or older. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Lumee is not directed at children under 13, and we do not knowingly permit children under 13 to create accounts.

2. Your account

When you first open Lumee, an anonymous account is created automatically using Firebase Authentication. No name, email address, or password is required to get started. You may optionally link your account to a Google or Apple account for added security and to enable account recovery.

You are responsible for maintaining the security of your device and account. If you use an anonymous account without linking it to a sign-in provider, we cannot recover your data if you lose access to your device or uninstall the app. We are not responsible for data loss resulting from unlinked anonymous accounts.

One account per person. You may not create accounts on behalf of others or use Lumee on a commercial basis to serve multiple end users.

3. Your content

You own everything you create in Lumee. Your intentions, journal entries, vision board images, affirmation preferences, and any other content you generate or upload ("Your Content") belong to you. We do not claim any intellectual property rights over Your Content.

By using Lumee, you grant us a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely for the purpose of operating the app and providing the service to you. This license ends when you delete the relevant content or your account.

We do not access, read, analyze, or use Your Content for any purpose other than operating the app on your behalf. We do not use Your Content to train machine learning models, serve advertising, or share with third parties (beyond the storage infrastructure described in our Privacy Policy).

4. Acceptable use

You agree to use Lumee only for lawful, personal purposes. You must not:

5. Subscriptions and billing

Lumee requires a subscription to access the full app. Subscriptions are offered on monthly and annual billing cycles, each with a free trial period as displayed on the subscription screen at the time of purchase.

Free trial. Your free trial begins on the date you start the trial and ends after the number of days specified at sign-up. If you do not cancel before the trial ends, your chosen subscription plan will activate and you will be charged.

Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current subscription price, unless you cancel at least 24 hours before the end of the current period.

Payment processing. All payments are processed by Apple (via the App Store) or Google (via Google Play), depending on the platform you use. We do not directly handle your payment card information. By subscribing, you also agree to Apple's or Google's applicable terms of service and payment policies.

Managing and cancelling your subscription. You can view, manage, or cancel your subscription at any time through your device's store settings — in the App Store under your Apple ID subscriptions, or in Google Play under your account subscriptions. Cancellation takes effect at the end of the current billing period; you will retain access to the app until then.

Refunds. Refund requests are handled by Apple or Google according to their respective policies. We do not process refunds directly. To request a refund, contact Apple Support or Google Play Support.

Price changes. We may change subscription pricing from time to time. We will provide advance notice of any price increase through the app or by email where required by applicable law. Your continued subscription after a price change constitutes acceptance of the new price.

6. Intellectual property

Lumee and all of its components — including the app design, graphics, user interface, curated content (affirmations, predefined intentions, style references), software code, and trademarks — are owned by Nadav Gelbard and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our intellectual property beyond what is necessary to use the app for its intended purpose.

7. Not a medical or mental health service

Lumee is a personal reflection and journaling tool. It is not a substitute for professional therapy, counseling, psychiatric care, or medical advice. The app does not provide mental health treatment and is not a crisis service. If you are experiencing a mental health crisis or have concerns about your mental or physical health, please contact a qualified professional or emergency services in your area.

Nothing in the app should be interpreted as professional advice of any kind.

8. Disclaimers

Lumee is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be available at all times, error-free, or free of viruses or other harmful components. We do not guarantee that the app will meet your specific requirements or that any results obtained from using the app will be accurate or reliable.

9. Limitation of liability

To the fullest extent permitted by applicable law, Nadav Gelbard and Lumee shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the app — including but not limited to loss of data, loss of profits, or loss of goodwill — even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising under or related to these Terms or your use of Lumee shall not exceed the greater of (a) the total amount you paid for a Lumee subscription in the 12 months immediately preceding the claim, or (b) fifty US dollars (US $50).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nadav Gelbard and Lumee from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the app; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.

11. Termination

By you. You may stop using Lumee and delete your account at any time from the Settings screen within the app. Deleting your account permanently removes all your data and cancels your account, but does not automatically cancel your subscription — you must cancel your subscription separately through the App Store or Google Play to stop future charges.

By us. We may suspend or terminate your access to Lumee at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. If we terminate your account for our convenience rather than for cause, we will provide a pro-rated refund of any prepaid subscription fees where required by law.

Upon termination, your right to use the app ceases immediately. Sections 3 (your content license survives for the purpose of deletion), 6, 7, 8, 9, 10, 12, and 13 of these Terms survive termination.

12. Changes to these Terms

We may update these Terms from time to time to reflect changes in the law, our practices, or the app's features. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice through the app at least 7 days before the changes take effect. Your continued use of Lumee after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the app and cancel your subscription before the effective date.

13. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the use of Lumee that cannot be resolved informally shall be subject to the exclusive jurisdiction of the competent courts located in Tel Aviv, Israel. If you are a consumer resident in the EEA or UK, this choice of law and jurisdiction does not deprive you of the protection of any mandatory consumer protection laws in your country of residence.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lumee regarding your use of the app and supersede any prior agreements or understandings on that subject.
